Summary: The Lodi Unified School District initiated preparation of a Notice of Intent to approve a Preliminary Endangerment Assessment (PEA). AB 387 and SB 162, enacted in 1999, and AB 2644, enacted in 2000, require that prior to any new construction, the site be examined for potentially hazardous substances consistent with the regulations of the Department of Toxic Substances (DTSC).
An advertised Public Hearing was held on November 17, 2020, this provided an opportunity for anyone to comment on the final draft report (PEA) assessing the presence of potentially hazardous substances. After receipt and consideration of all comments, at an advertised Public Hearing, the Notice of Intent to Approve a Preliminary Endangerment Assessment (PEA) was certified by the Board of Education. Approval will allow staff to complete all other documents and certifications required for California Department of Education (CDE) and Office of Public School Construction (OPSC) approval of this site.
Funding: There is no financial impact on the District.
Recommendation: It is recommended the Board of Education adopt Resolution 2020-75.
